[周刊王CTWANT] 大陸陜西省西安市一對準新人原本甜蜜的選購「三金」之旅,卻因為一只金手鐲,陷入了意想不到的糾紛。2024年1月,劉姓準新郎帶著未婚妻來到碑林區某金飾店選購三金;女友看中一款標價人民幣1.6萬元(約新台幣7.2萬元)的金手鐲,25克足金打造,表面雕刻花紋精緻,下秒發生的事卻讓人當場傻眼。
綜合陸媒報導,店員當時小心翼翼地把金手鐲拿出來為女子試戴,但是目測尺寸偏小,於是店員便將手鐲平放在玻璃櫃台上,同時建議女方可以看看其他手鐲,品相與質量也都非常不錯。就在女友重新挑選手鐲的過程中,劉男拿起手鐲握在掌心掂量,想看看質量,誰知僅用單手一捏,原本渾圓的手鐲瞬間扭曲變形。
突如其來的變故讓在場所有人直接傻眼。劉男認為,自己在試戴前,店員並未提醒該手鐲質地特殊,容易變形,也沒有告知手鐲是空心的,在自己認知裡,正常的金手鐲不至於輕輕一捏就變形。業者說,該金手鐲採用古法工藝,加上變形程度較嚴重,已無法按照正常商品進行銷售,只能作為金料回收,實際損失高達5000元,要求劉男賠償。
對於金店要求,劉男無法接受,雙方各執一詞,對簿公堂。經過深入調查和嚴謹的審理,法院查明,涉案手鐲為後壁空心足金手鐲,含金量為99.9%,這種材質具有質地柔軟的特點。劉男作為理智成熟的成年人,應當要思慮周全,但他未注意到質量的軟硬度,用力不當導致手鐲變形,存在主要錯誤,侵害了店家的合法財產權益,因此要承擔相應的責任。
不過,法院也指出,金飾店作為專業的銷售商家,其銷售人員在顧客試戴金鐲的過程中,沒有根據試戴人的條件給予正確建議和指導,也未能及時告知試戴人商品的屬性以及妥善保管的義務,業者無法提供證據證明其已盡到相關謹慎義務,因此存在一定過錯,需承擔部分責任。
綜合雙方過錯程度,法院酌情判令由金飾店承擔20%責任,劉男承擔8成責任。關於損失價值,金店主張金鐲只能作為金料回收,卻未提供充分有效的證據證明。考慮涉案金鐲只是輕微變形,法院參照該金鐲的工費,認定金店的損失為1700元。按照責任比例,劉男應當向金店賠償的損失為1360元。
